For anyone with children, child custody arrangements are always at the top of the priority list during divorce disputes. At FK Law Group, we are ahead of the curve when it comes to all past, current and proposed New York laws related to divorce, custody and overall family law.
Some people may not be aware that New York child custody law does not give a preferred right to custody to either parent. The legal mother and father essentially have equal rights to custody of their children.
On what basis does New York divorce court grant custody?
It’s standard for the court to decide custody in the child’s best interests. This means that the court determines who is the child’s primary caretaker. It also looks at the home in which the child would reside and conducts an evaluation of the parent’s mental health, looking for any substance abuse issues.
When it comes to custody and visitation cases, a majority of New York and Queens courts end up appointing an “Attorney for the Child.” This attorney serves as the impartial legal decider of the best custody arrangement for the child. While the court may hear the child’s wishes, it will not necessarily grant them. The age of the child does play a role, as older childrens’ opinions are usually taken into consideration more than younger kids.
